01About these terms
These terms apply to your use of itsonmedia.com, including our blog at itsonmedia.com/blog, which is run by Its On Media LLC (“Its On Media”, “we”, “us”), a software and web development company based in Fresno, California.
By using our website, you agree to these terms. If you don’t agree, please don’t use the site. Our Privacy Policy explains how we handle the information you share with us, and forms part of these terms.
02Using our website
You’re welcome to browse our site, read our content, use our tools and get in touch. When you do, please don’t:
- use the site for anything unlawful, fraudulent or harmful;
- send spam, false enquiries or automated submissions through our forms;
- try to get around our security, including the bot checks and submission limits on our forms;
- try to gain unauthorized access to our site, our systems or the systems that receive form submissions;
- upload or send viruses or other harmful code, or do anything that could disable, overload or damage the site;
- copy or scrape the site in bulk, or reuse our content in a way these terms don’t allow (see section 7);
- pretend to be someone else, or misrepresent your connection with any person or business.
We may block access, or refuse or delete submissions, where we reasonably believe these terms are being broken.
03Estimates and planning tools
Our site includes free tools to help you plan, such as the software development cost calculator, the project cost estimator and the AI readiness assessment.
- Cost estimates are indicative ranges only. They are worked out from the options you select and are meant to help you plan a budget. They are not a quote, an offer or a commitment by either of us. We confirm scope before final pricing, and the price of any project is set only in a written proposal or agreement.
- The AI readiness assessment is a quick self-assessment to guide your thinking, not a formal audit or professional advice.
Using a tool, or sending us your results, doesn’t create any obligation for you or for us.
04General information only
The content on our site, including our service pages, industry pages, case studies, guides and blog posts, is general information about our work and our field. It isn’t legal, regulatory, compliance, financial or other professional advice for your situation.
Where we write about regulations or standards, such as HIPAA, GDPR, CCPA or SOC 2, we describe how we approach them in our work. That isn’t a guarantee that a particular product will be compliant, so please get advice from a qualified professional before relying on it. We work to keep our content accurate and current, but it may not always be complete or up to date.
05Client projects
These terms cover your use of our website, not the services we provide to clients. If you work with us, that project is governed by the written proposal, agreement or statement of work we both sign, including its terms on scope, pricing, payment, timelines and ownership of the work. If that agreement conflicts with these terms, the agreement takes precedence.
Sending us an enquiry, requesting an estimate or booking a call doesn’t, on its own, make you a client or create an agreement between us.
06What you send us
When you contact us or use our forms, please give accurate information and share only details you have the right to share. Please don’t send sensitive information, such as health records, financial account numbers or government ID details, through our forms.
Sending us a project idea through our site doesn’t, on its own, create a confidentiality agreement. If you’d like an NDA before sharing the details of your project, tell us and we’ll arrange one before you do. We handle everything you send us in line with our Privacy Policy.
07Our content and trademarks
The content on our site, including its text, design, graphics, icons, images, illustrations, animations and code, belongs to Its On Media or the people who license it to us, and is protected by copyright and other laws. “Its On Media” and our logo are our trademarks.
You may view our site and print or save pages for your own reference or your business’s internal use, and you may share links to our pages. Otherwise, please don’t copy, republish, sell or create derivative works from our content, or use our name or logo, without our written permission. You can ask for permission using the details in section 15.
08Client work and reviews
Our case studies and portfolio show work we’ve done for clients. Client names, logos, products and screenshots belong to their respective owners, and showing them doesn’t give you any right to use them. Results described in a case study reflect that particular project and aren’t a promise of the same results for yours.
Reviews and testimonials on our site, including reviews shown from Google, reflect the views of the people who wrote them.
09Links and third-party services
Our site links to other websites, such as client projects, our social media profiles and review sites, and includes services run by other companies, such as the Calendly booking calendar and the Google map on our contact page. We don’t control those websites or services and aren’t responsible for their content, availability or practices. Their own terms and privacy policies apply when you use them.
10Disclaimers
We provide our website, tools and content “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind about them, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose or non-infringement.
We don’t promise that the site will always be available, uninterrupted or free of errors or harmful code, and we may change, suspend or remove any part of it at any time.
11Limitation of liability
To the fullest extent the law allows, Its On Media and its owners, employees and contractors won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising from your use of, or inability to use, our website, tools or content, even if we were told such damages were possible.
Some places don’t allow certain warranties to be excluded or certain liability to be limited, so some of the limits in this section and section 10 may not apply to you. Nothing in these terms limits any liability that can’t be limited under applicable law.
12Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising from these terms or your use of our website will be resolved in the state or federal courts located in Fresno County, California, and you and we agree to the jurisdiction of those courts.
13Changes to these terms
We may update these terms as our website, services or the law change. When we do, we’ll change the “Last updated” date at the top of this page. The version on this page when you use the site is the one that applies, so please check back from time to time.
14General
- If any part of these terms is found to be unenforceable, the rest of the terms stay in effect.
- If we don’t enforce part of these terms straight away, we can still enforce it later.
- Together with our Privacy Policy, these terms are the whole agreement between you and us about your use of our website. A signed agreement for a client project is separate, as described in section 5.
